When Elon Musk decided to rebrand Twitter as X back in 2023, he made it clear the iconic blue bird was flying away for good. Now, a Virginia-based startup called Operation Bluebird wants to bring it back, and they’re not asking Musk for permission.
Operation Bluebird filed a petition with the U.S. Patent and Trademark Office on December 2, asking to cancel the trademarks for “Twitter” and “tweet.” Their argument is straightforward: X Corp stopped using these brands commercially, which under U.S. trademark law counts as abandonment. The startup plans to launch a rival platform called “twitter.new” if they succeed.
The man behind the challenge
Here’s where it gets interesting. The petition was filed by Stephen Coates, Operation Bluebird’s general counsel who previously worked as a trademark lawyer at Twitter. Coates argues the case is simple, X eliminated the Twitter brand from products, services, and marketing after Musk’s $44 billion acquisition. The billionaire even posted in 2023 that the company would “bid adieu to the Twitter brand and, gradually, all the birds.”
The bluebird logo vanished, twitter.com redirected to x.com, and the entire brand identity disappeared. According to trademark law, non-use for three consecutive years is evidence of abandonment, which puts X Corp in a tricky position.

The legal battle ahead
If Operation Bluebird wins, they could claim one of tech’s most recognizable brand names. But X Corp renewed its Twitter trademark registration last year despite the rebrand, creating an unusual legal situation. Intellectual property lawyer Josh Gerben noted that X might face obstacles defending trademarks they no longer use, though they could still try blocking commercial use of the name.
The case raises questions about what happens when companies completely walk away from legacy brands. Whether defending a brand you deliberately discarded or losing it to competitors, X Corp faces a no-win situation that could set precedents for future rebranding efforts across the tech industry.
